Event Waiver & Release of Liability

Please read this Waiver & Release of Liability (the "Release") carefully. It affects your legal rights. By requesting an invitation to, registering for, and/or attending the Event, you ("you", the "Participant") agree to be bound by this Release.

1. Definitions

"Organizer" means Super Luxury Group LLC and House of Wellness Brickell. "Released Parties" means the Organizer and its and their owners, members, managers, officers, employees, agents, contractors, hosts, speakers, wellness practitioners, vendors, sponsors, partners, the owner and occupants of the Event premises, and each of their respective affiliates, successors and assigns. "Event" means the activation described above and all related activities, whether on or off the premises.

2. Voluntary Participation

You are participating in the Event voluntarily and of your own free will. You are not required to take part in any activity and may decline or stop participating in any activity at any time.

3. Assumption of Risk

You understand that the Event may include physical movement and wellness activities, breathwork, cold and heat exposure, biohacking and wellness technologies, guided experiences, food and beverage tastings, alcohol service, and access to a private residence with pools, water features, rooftops, stairs, and outdoor areas. You acknowledge that these activities and the premises carry inherent and other risks, including but not limited to physical injury, illness, allergic reaction, aggravation of pre-existing conditions, slips and falls, drowning, property damage, and, in rare cases, serious injury or death. You knowingly and freely assume all such risks, both known and unknown, and assume full responsibility for your participation.

4. Health & Fitness Representation

You represent that you are in good health and physically and mentally able to participate, or that you have chosen to participate despite any condition. You are solely responsible for knowing your own limits, for any food allergies or dietary restrictions, and for consulting a physician before participating if you have any doubt. You agree to disclose relevant health information to staff when appropriate and to stop any activity that causes discomfort.

5. Release & Waiver of Liability

To the fullest extent permitted by Florida law, you hereby release, waive, discharge, and covenant not to sue the Released Parties from and for any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, illness, or injury (including death) to you or your property, whether caused by the ordinary negligence of the Released Parties or otherwise, that occurs in connection with the Event. This Release does not apply to liability that cannot be waived as a matter of law, including gross negligence or willful misconduct.

6. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, or cost (including reasonable attorneys' fees) they may incur arising out of your participation in the Event, your breach of this Release, or your violation of any law or the rights of any third party.

7. Medical Treatment

In the event of injury or illness, you authorize the Organizer to arrange emergency medical care on your behalf. You are responsible for the cost of any medical treatment and understand that the Organizer is not obligated to provide medical care and assumes no responsibility for it.

8. No Medical or Professional Advice

The Event and its wellness content are provided for informational and experiential purposes only and are not medical, health, nutritional, or professional advice, diagnosis, or treatment. Nothing at the Event should be relied upon as a substitute for advice from a qualified professional.

9. Personal Property

The Released Parties are not responsible for any loss of, or damage to, your personal property before, during, or after the Event.

10. Alcohol & Conduct

Alcoholic beverages, if served, are for guests of legal drinking age (21+) only, and you agree to consume responsibly. The Organizer may refuse entry to or remove any person for unsafe, disruptive, or inappropriate conduct, without refund or liability.

11. Photography, Video & Content

You acknowledge that the Event will be photographed and recorded, and that your image, likeness, and voice may be captured. Your participation is also subject to the separate Photo, Video & Content Release, which you agree to at registration.

12. Communicable Illness

You understand that any gathering carries a risk of exposure to communicable illnesses, and you voluntarily assume that risk as part of your participation.

13. Force Majeure

The Organizer is not liable for any failure or delay, or for changes to or cancellation of the Event, caused by circumstances beyond its reasonable control, including weather, acts of God, government action, or emergencies.

14. Governing Law; Severability; Entire Agreement

This Release is governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Any dispute shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida. If any provision is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision shall be enforced to the greatest extent permitted by law. This Release, together with the Photo, Video & Content Release, is the entire agreement between you and the Organizer regarding its subject matter.

15. Acknowledgment & Electronic Signature

I have read this Waiver & Release of Liability, fully understand its terms, and understand that I am giving up substantial rights by agreeing to it. I agree freely and voluntarily. I understand that checking the consent box and submitting the registration form constitutes my electronic signature under the U.S. E-SIGN Act and Florida's Uniform Electronic Transaction Act, and is intended to have the same legal effect as a handwritten signature.
